MR. PRIME STATING ITEM #4 OF THE REVIEW LETTER WHICH IS SELF-SERVICE FUELING IS NOT PERMITTED UNDER NEW JERSEY LAW. ACTUALLY AND THIS IS NOT COMMON KNOWLEDGE, THE SALE OF DIESEL FUEL CAN BE SELF-SERVED IN NEW JERSEY. IT IS SEPARATE THAN REGULAR GAS SALES. SO DIESEL CAN BE OPERATED AS A SELF-SERVE. I HAVE A STATUE HERE, IT IS THE NEW JERSEY ADMINISTRATOR CODE SECTION 12-196, 1.1, IT SPECIFICALLY CARVES OUT DIESEL SALES AS AN EXCEPTION. MR. PRIME GIVING COPY TO BOARD SOLICITOR AND BOARD ENGINEER.

BOARD SOLICITOR STATING ARE YOU PLANNING TO HAVE A SELF-SERVE DIESEL?
MR. PRIME STATING YES WE ARE, IT IS PART OF THE APPLICATION THAT MR. KLAUSS WILL TESTIFY TO, THE KIOSK WILL BE REMOVED ON THE SECTION WHERE THE PUMPS ARE, WHICH WOULD HAVE HOUSED THE WORKERS. IT IS A SELF-SERVICE OPERATION.

MR. PRIME STATING THE ANTICIPATED TIME OF CONSTRUCTION, I HAVE KRISTIN RITZ HERE FROM WAWA WHO CAN TESTIFY. THEY ARE NOT SURE, ASSUMING WE CAN GET THE PERMIT QUICKLY IF WE ARE APPROVED TONIGHT, THEY WOULD LIKE TO START IN THE NEXT COUPLE OF MONTHS.

MR. KLAUSS STATING THE SITE IMPROVEMENTS ARE RELATIVELY MINOR ON THIS APPLICATION. AS PART OF THE DIESEL OPERATION, WE ARE GOING TO INSTALL ONE DIESEL ONLY UNDERGROUND STORAGE TANK. IT WILL BE A 15,000 GALLON STORAGE TANK. IT WILL BE PLACED IN THE GENERAL AREA NEXT TO WHERE THE EXISTING (3) UNDERGROUND STORAGE TANKS ARE LOCATED. IN ADDITION (2) OF THE MULTI-PRODUCT DISPENSER AND THEY ARE ON THE WESTERN END OF THE CANOPY, THOSE (2) MULTI-PRODUCT DISPENSER WILL BE REMOVED. THOSE MULTI-PRODUCT DISPENSERS WILL THEN BE REPLACED, THEY ARE NOT GASOLINE, THEY WILL BE REPLACED WITH THE DIESEL ONLY MUTI-PRODUCT DISPENSERS. THEY WILL BE SIMILAR IN NATURE, THAT THERE WILL BE FUELING POSITIONS ON BOTH SIDES.

MR. KLAUSS STATING FROM THE SIGNAGE STANDPOINT, SOME MINOR SIGNAGE MODIFICATIONS, IN ORDER TO FURTHER DETRACT TRACTOR TRAILERS FROM WANTING TO FUEL AT THIS LOCATION. WE PROVIDE NO TRACTOR TRAILER FUELING SIGNS ON EITHER SIDE OF THE CANOPY COLUMNS. COMMENT #5, REQUEST THAT SAME SIGN BE POSTED IN THE AREA OF THE OVERSIZED VEHICLE SPACES WHICH IS LOCATED TO THE NORTH SIDE OF THE CANOPY. WAWA WILL HAVE NO PROBLEM POSTING AN ADDITIONAL SIGN THERE.

MR. KLAUSS STATING WHAT WE WILL DO WITH THE (2) DIESEL PUMPS, THEY WILL INDICATE THE DIESEL FUELING OPERATION. FROM A SIGNAGE STANDPOINT THERE IS AN EXISTING FREE STANDING SIGN UP ALONG THE WHITE HORSE PIKE, WE WOULD REFACE, SO THE TOP PORTION THAT INDICATES WAWA WOULD REMAIN, THE PRICING PANEL WOULD BE REMOVED AND INSTEAD OF SAYING REGULAR, PLUS AND PREMIUM. WE WOULD NOW HAVE REGULAR AND DIESEL PRICING WITHIN THAT AREA. THE SIZE OF THE SIGN WILL NOT CHANGE AT ALL.

MR. KLAUSS STATING TO THE COMMENTS THAT ARE ON PAGE (2) OF ENVIRONMENTAL RESOLUTIONS 2/1/12 LETTER. ITEM #4, THAT IS ABOUT THE SELF-SERVICE OPERATION OF THE DIESEL. ITEM #5, I’VE TALKED ABOUT AND WE WILL POST AN ADDITIONAL NO TRACTOR TRAILER FUELING SIGN. ITEM #6, AS FAR AS IMPACT TO PARKING LOT CIRCULATION, SHOWING ON PLAN, THE TANK LOCATION, WAWA WILL FENCE OFF THE AREA OF CONSTRUCTION. THIS AREA LOCATED WHERE THE PROPOSED 15,000 GALLON TANK IS AND A LITTLE TO THE SIDE OF IT, THAT WOULD BE FENCED OFF SO THEY CAN PERFORM THE EXCAVATION OPERATION, PLACEMENT OF THE TANK, BACK FILL, PUT THE CONCRETE PAD ON TOP OF THE TANK AND THEN REPAIR THE ASPHALT AROUND IT. IN ADDITION THEY WILL FENCE OFF THE AREA TO THE WESTERN END OF THE CANOPY, WHERE THOSE MULTI-PRODUCT DISPENSERS WILL BE LOCATED SO THEY CAN THEN REMOVE THE MULTI-PRODUCE DISPENSERS, REPLACE WITH THE DIESEL DISPENSERS, REMOVE THE KIOSK AND THE LAST PIECE OF THAT WOULD BE THE PIPING OPERATION WHICH WE WILL NEED TO RUN ADDITIONAL PIPING FROM THE PROPOSED TANK LOCATION TO THOSE NEW MULTI-PRODUCT DISPENSERS AND ALSO RUN SOME VENTING BACK TO THE VENT STACK PAD WHICH IS LOCATED JUST TO THE NORTH OF THE THAT. AN OVERALL TIMING STANDPOINT, CONSTRUCTION WISE, IT TAKES GENERALLY AROUND (2) WEEKS. FROM A SITE CIRCULATION STANDPOINT BECAUSE THE AREA OF THE TANK AND THE AREA AROUND THE MULTI-PRODUCT DISPENSERS WILL BE FENCED OFF SEPARATELY, IT WILL STILL ALLOW FOR VEHICULAR CIRCULATION BETWEEN THOSE AREAS. THE ONLY TIME THAT WOULD NEED TO BE SHUT DOWN WOULD BE SO WE COULD BRING THAT PIPE FROM THE TANK ACROSS TO THE MULTI-PRODUCE DISPENSERS, THAT MAY BE ONE DAY WHERE WE WILL NEED TO PUT A CLOSURE AREA IN THERE TO RUN THE PIPE, BACKFILL AND PLACE THE ASPHALT ON TOP. IN REGARDS TO ITEM #7, ANTICIPATED DATES AND TIMES UNKNOWN AT THIS TIME. IT WILL DEPEND ON A LOT OF ISSUES, MAINLY WHEN WE GET APPROVAL WHEN THIS APPROVAL FALLS IN LINE WITH SOME OF THE OTHER APPROVALS AND WHEN THEY CAN SLOT THAT FOR CONSTRUCTION.

BOARD SOLICITOR STATING THE APPLICANT ANSWERED MY COMMENTS SUFFICIENTLY. I’LL NOTE THAT ALL WAIVERS AND VARIANCES WERE GRANTED AS PART OF THE PRIOR APPLICATION AREN’T AFFECTED BY THIS AMENDED APPLICATION.

COUNCILMAN BALMER STATING DO ANY OF YOU KNOW THE FLASH POINT OF DIESEL FUEL. CAN IT BE IGNITED WITH A MATCH?
MR. KLAUSS STATING NO, IF YOU READ THE HANDOUT, IT ACTUALLY GOES INTO THAT. THAT IS ONE OF THE EXPLANATIONS OF WHY DIESEL CAN BE SELF-SERVICE.

MR. WELLS STATING AREN’T THERE NEW VEHICLES COMING OUT WITH AN ADDITIONAL FUEL THAT HAS TO BE MIXED WITH DIESEL?
MR. KLAUSS STATING I AM NOT FAMILIAR WITH THAT. WAWA HAS BEEN FOCUSED ON THE DIESEL ASPECT OF THESE NEWER AND CLEANER VEHICLES, WHICH IS WHY ON THIS STORE AND A LOT OF OTHER STORES, NOT ONLY IN NEW JERSEY BUT THROUGHOUT THE OTHER STATES THEY HAVE STORES. THEY ARE LOOKING TO DO THESE DIESEL UPGRADES OR CONVERSIONS BECAUSE OF THAT. BUT I AM NOT AWARE OF ANY OTHER TYPE OF DIESEL MIXTURE FOR NEWER VEHICLES.

MR. SCHWARZWALDER STATING IF A PERSON IS GOING TO SELF-SERVE, IF THEY HAVE A CREDIT CARD, I ASSUME THAT THE PUMP WILL ACCEPT IT.
MR. KLAUSS STATING YES.
MR. SCHWARZWALDER STATING IF THEY ARE GOING TO PAY WITH CASH, DOES THAT MEAN THEY WILL HAVE TO LEAVE THEIR CAR, GO INSIDE THE STORE, GET IN LINE AND PAY CASH.
MR. KLAUSS STATING YES THEY WOULD HAVE TO DO THAT.

MR. SCHWARZWALDER STATING DO YOU INTEND TO REDUCE THE STAFF AT THE STORE AS A RESULT OF THIS?
MS. RITZ STATING WE WILL BE REMOVING THE KIOSK THAT IS LOCATED AT THE (2) DIESEL PUMPS. HOWEVER, THE TYPICAL AMOUNT OF STAFF THAT WE HAVE WILL REMAIN.

MR. SCHWARZWALDER STATING I READ THROUGH THE MATERIAL AND IT DISCUSSED THE BAN ON TRACTOR TRAILERS BUT YOU DID NOT PRECLUDE BUSES IN THE WRITE UP. I HAVE CONCERNS ABOUT THAT, I DON’T KNOW ABOUT THE SIZE OF THE NOZZLE THAT GOES INTO THE BUS WHETHER THAT HAS THE SAME ISSUE AS THE TRACTOR TRAILER DOES OR NOT.
MS. RITZ STATING BUSES TYPICALLY HAVE FUEL STATIONS AT THEIR DEPOT, THEY WOULDN’T BE ABLE TO FILL UP AT OUR LOCATIONS, IT WOULDN’T BE EFFICIENT FOR THEM AND THEY COULDN’T USE THEIR CORPORATE CARDS TO KEEP TRACK OF THE FUEL THEY’VE GONE THROUGH. IT WOULD BE FROWNED UPON WITHIN THEIR ORGANIZATION TO FUEL UP AT A PLACE LIKE A WAWA OUTSIDE OF THEIR OWN DEPOT.

MR. SCHWARZWALDER STATING I KNOW YOUR FACILITY IS RELATIVELY NEW, YOU ARE GOING TO BE DOING EXCAVATION RIGHT NEXT TO THE EXISTING FUEL TANKS, IS THE CONTRACTOR REQUESTED TO TEST THE SOIL THAT THEY ARE REMOVING? WE ALL ARE ASSUMING THAT NONE OF THOSE TANKS LEAKED BUT WHEN THEY OPEN UP THE HOLE YOU DON’T KNOW WHAT THEY ARE GOING TO FIND.
MS. RITZ STATING YES, THEY DO ALL THE TYPICAL ENVIRONMENTAL TESTING THAT ANYONE WOULD DO IF YOU ARE OPENING UP A HOLE TO SET IN A NEW TANK. THIS HOLE IS 10 FEET AWAY FROM THE EXISTING HOLES AND THEY USE THE BARRIERS, THEY TEST THE SOIL, THEY TEST EVERYTHING.

BOARD ENIGEER STATING ADDITIONALLY MOST OF THE NEWER MODEL TANKS THESE DAYS HAVE A WALL WITH ELECTRONIC MONITORING WHERE AS OLDER TANKS DIDN’T HAVE THAT TECHNOLOGY.
MR. KLAUSS STATING WAWA NOT ONLY HAS DOUBLE WALL TANKS BUT ALSO THE PIPING IS DOUBLED WALLED. IT IS ALL MONITORED AT THE STORE AND AT WAWA CORPORATE. IF THERE WERE A LEAK, WAWA WOULD KNOW ABOUT IT IMMEDIATELY AND WOULD BE ADDRESSING IT.
